IMPORTANT — PLEASE READ CAREFULLY. These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user") and Publeey ("we", "us", or the "Service"). By creating an account, paying the signup fee, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Publeey is a software platform offering AI-powered tools to generate ebooks, book covers, coloring books, puzzle books, journal books, and related creative artifacts. The Service is provided on an "as-is" and "as-available" basis. Features, pricing, and credit costs may change at any time at our discretion.
2. Accounts
- You must be at least 16 years old to create an account.
- You must provide accurate, current, and complete information at registration.
- One human, one account. Creating multiple accounts to circumvent fees, abuse promotions, or whitelist invitations is prohibited.
- You are responsible for keeping your password confidential. You are liable for all activity on your account.
- The first user account on a fresh deployment becomes the platform administrator and is not subject to the signup fee.
3. Signup Fee, Credits, and Payment
- Signup fee. Public signup requires a one-time non-refundable fee of US$2, which includes 500 starter credits. Whitelisted invitations bypass this fee and receive 200 starter credits.
- Credits. Credits are a virtual prepaid token used to access generators. They have no monetary value outside the Service, are non-transferable, and cannot be converted back to cash except via the refund policy below.
- Pricing. Current credit pack pricing is published on the Pricing page. Per-operation credit costs may change with prospective effect; we will give reasonable advance notice for material changes.
- Payments. Processed exclusively through PayPal. Payment authorization grants us the right to charge the amount displayed at checkout.
- Taxes. Prices are exclusive of any taxes that may apply in your jurisdiction; you are responsible for those.
4. Refund Policy
- Credit packs are refundable within 7 days of purchase if you have not spent more than 10% of the credits in that pack.
- The $2 signup fee is non-refundable once paid (the included 500 starter credits cannot be reversed).
- Refunds are processed back to the original PayPal account.
- To request a refund, email support@publeey.com with your PayPal order ID.
- We reserve the right to deny refunds where abuse is suspected (e.g. excessive refund requests, fraudulent chargebacks).
5. Acceptable Use
You agree NOT to use the Service to generate, request, store, distribute, or sell content that:
- Infringes any copyright, trademark, trade secret, patent, publicity right, or other intellectual property right of any third party.
- Depicts minors in any sexual or exploitative context, or any other child sexual abuse material.
- Promotes terrorism, violent extremism, mass-violence planning, or illegal weapons.
- Constitutes harassment, hate speech, defamation, or threats targeting any individual or protected class.
- Provides instructions for creating weapons of mass destruction, harmful biological agents, or executing cyberattacks.
- Violates any applicable law in your jurisdiction or the jurisdiction where the content will be distributed.
- Impersonates a real person without their consent.
- Misleads consumers (fake reviews, fake testimonials, fake credentials).
You also agree NOT to:
- Reverse-engineer, decompile, scrape, or otherwise extract source code from the Service.
- Abuse rate limits, automate account creation, or use bots/scripts to consume credits in bulk against our terms.
- Resell access to the Service or rent your account credentials.
- Initiate chargebacks for valid charges without first contacting us to seek resolution.
We may suspend or terminate accounts that violate these rules, with or without notice, and without refund.
6. Your Content and Ownership
- Your prompts. You retain all rights to the text prompts and inputs you submit. You grant us a limited license to process those inputs for the sole purpose of delivering the Service to you.
- Generated output. Subject to your compliance with these Terms, you own the AI-generated artifacts ("Output") created for you through the Service. You are free to use, modify, publish, and sell the Output on any book or ebook marketplace, retail shop, or other distribution channel of your choice.
- Your responsibility. You are solely responsible for ensuring that your prompts and your use of the Output comply with: (i) applicable laws; (ii) third-party rights including intellectual property; and (iii) the policies of any marketplace, retailer, or platform where you publish or sell the Output. We make no representation that AI Output is original, unique, copyrightable in your jurisdiction, or free of third-party rights.
- License to us. You grant us a non-exclusive, worldwide, royalty-free license to store, transmit, process, and display your prompts and Output strictly to operate and maintain the Service, to comply with legal obligations, and to enforce these Terms. We do not use your Output to train AI models or for any other commercial purpose unrelated to delivering the Service to you.
7. AI Limitations & No Professional Advice
AI-generated content may be factually incorrect, biased, outdated, offensive, or otherwise inappropriate. The Service is not a substitute for professional advice — legal, medical, financial, psychological, safety, or otherwise. You must independently verify any factual claims, statistics, recommendations, instructions, or advice before relying on them or publishing them. Do not use the Output to make decisions where errors could cause material harm without first consulting a qualified professional.
8. Third-Party Services
The Service integrates AI providers (Anthropic, Pollinations, KIE), payment processors (PayPal), and hosting infrastructure. Their actions and outages are outside our control. We disclaim liability for damages caused by third-party providers, while still working in good faith to switch providers where availability is compromised.
9. Service Availability
We use commercially reasonable efforts to keep the Service available, but we do not guarantee uninterrupted, error-free, or timely operation. Scheduled and unscheduled downtime may occur. Credits are not automatically credited for downtime; if extended downtime materially impacts you, contact support.
10. Disclaimer of Warranties
The Service and all Output are provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties including, without limitation, merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and quiet enjoyment, to the maximum extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost royalties, lost data, reputational harm, business interruption, or marketplace account suspension by any third-party platform.
- Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) US$50, or (b) the total amount you paid to us in the 30 days immediately preceding the event giving rise to the liability.
- These limits apply regardless of legal theory (contract, tort, statute, etc.) and even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless Publeey, its operators, contractors, and affiliates from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your prompts or Output; (b) your use of the Output (including distribution and sale on any marketplace); (c) your violation of these Terms; (d) your violation of any law or third-party right.
13. Termination
You may stop using the Service at any time. You may request account deletion via support. We may suspend or terminate your account, with or without notice, if you breach these Terms, if continued provision becomes commercially unviable, or as required by law. Upon termination, your access ends; unspent credits are forfeited unless termination resulted from our material breach. Sections 6 (license to us), 10–12 (warranties, liability, indemnity), 14–17, and any provision that by its nature should survive, do survive termination.
14. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law rules. Any dispute arising from or relating to the Service shall first be attempted to be resolved through good-faith negotiation. Failing that, disputes shall be submitted to the competent courts of Jakarta, Indonesia, which both parties consent to as exclusive jurisdiction. This does not affect your non-waivable consumer rights under your local law.
15. Changes to These Terms
We may revise these Terms from time to time. Material changes will be notified via email and/or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
16. Entire Agreement; Severability
These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and us. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full force.
